1. Introduction
Welcome to Founders Media. These Terms of Service ("Terms") govern your use of our video production and media optimization services. By using our services, you agree to these Terms. Please read them carefully.
2. Services Description
Founders Media provides video production and media optimization services, focusing on creating media that generates leads while you sleep, using simplicity, clear communication, and media leverage to grow your business.
Specific deliverables and project scope will be clarified through direct communication and documented in your project dashboard.
3. Client Responsibilities
3.1. You agree to provide accurate and complete information necessary for us to perform our services, either through our autonomous onboarding process or direct consultation.
3.2. You are responsible for ensuring you have the right to use any content you provide to us for incorporation into our work.
3.3. You agree to review and provide feedback on our work within specified timeframes to meet agreed-upon deadlines.
4. Intellectual Property
4.1. Upon full payment, you will own the rights to the final video assets we create for you.
4.2. Unless otherwise agreed upon in writing, Founders Media retains the right to:
Showcase the work in our portfolio
Use the work as examples in our marketing materials
Reference the work in case studies If you prefer your work not to be showcased publicly, please inform us at the start of the project.
4.3. Any pre-existing intellectual property of Founders Media used in creating your deliverables remains the property of Founders Media, including:
Our Visual Engineering™ process
Our animation templates and frameworks
Our production methodologies
4.4. Even if we don't showcase your work publicly, we reserve the right to refer to our work for you in offline conversations with prospective clients, unless explicitly prohibited by a separate non-disclosure agreement.
5. Payment and Billing
5.1. Service Pricing:
The Hero's Journey: $2,499 USD
The Founders' Video Funnel: Custom pricing based on scope
5.2. Payment Terms:
50% of total payment due upon completion of onboarding
Initial payment triggers start of production and R&D
Remaining 50% will be charged upon delivery of the final video in your Notion customer dashboard
All payments processed through Stripe
5.3. We reserve the right to pause work on projects with overdue payments.
6. Project Communication and Revisions
6.1. Communication Channels:
Each client receives a private Slack channel and Notion dashboard
All project communication and assets will be managed through these platforms
6.2. Revision Process:
Three (3) external revision rounds included
Client must provide revision requests within 18 hours of draft delivery
All revision requests must be submitted through Notion or Slack
Detailed revision requests should include thorough breakdown of desired changes
6.3. Response Times:
Clients must provide revision feedback within 18 hours of draft delivery
If no response is received within 18 hours:
An automatic reminder will be sent via email
Additional notifications will be sent through Slack
Any delays in client feedback will automatically extend the project timeline
Extension period will match the length of accumulated delays
6.4. Additional Revisions:
Additional revision rounds beyond the included three rounds may incur extra charges
Pricing for additional revisions will be discussed as needed
7. Data Management and Security
7.1. Project Data:
All project materials are stored securely in Notion
Video assets are hosted on Vimeo
Communication is maintained through Slack
7.2. Data Retention:
Upon project completion, all Slack channels and Notion dashboards will be archived
Clients maintain access to their archived content for 18 months after project completion
Clients are encouraged to download and store all their files locally
Archived project data is securely stored in Founders Media's archives
8. Project Cancellation
8.1. Cancellation Process:
Written notice required via email to cancel@fnd.media
Cancellation requests will be processed within 2 business days
8.2. Cancellation Before Initial Payment:
No penalty for cancellation before 50% initial payment is made
8.3. Cancellation After Production Begins:
If cancellation occurs after the initial 50% payment:
The initial 50% payment is non-refundable as it covers R&D and production costs
No obligation to pay the remaining 50%
All work completed up to cancellation date will remain property of Founders Media
9. Limitation of Liability
9.1. Founders Media's liability is limited to the amount paid for our services.
9.2. We are not liable for any indirect, consequential, or incidental damages.
10. Indemnification
You agree to indemnify and hold Founders Media harmless from any claims, damages, or expenses arising from your use of our services or any content you provide.
11. Subcontractors
Founders Media may, at its discretion, use qualified subcontractors to fulfill part of its obligations under these Terms. Founders Media will remain fully responsible for all work performed by subcontractors.
12. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation, both parties agree to resolve the dispute through binding arbitration in Oslo, Norway, in accordance with the rules of the Oslo Chamber of Commerce.
13. Governing Law
These Terms are governed by the laws of Norway, without regard to its conflict of law provisions.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any significant changes.
